TopBuyers is a free directory connecting property buyers with Australian buyer’s agents. We don’t sell property, give financial advice, or guarantee any agent’s services. We make money from agents who pay for Featured listings. Buyers pay nothing.
The full terms below are the binding version. Where these terms conflict with the Australian Consumer Law, the Australian Consumer Law prevails.

1. Who we are and how to contact us
“TopBuyers”, “we”, “us” or “our” means the operator of the website at topbuyers.com.au (the “Platform”). For all matters relating to these Terms of Service (“Terms”), contact us at hello@topbuyers.com.au.
2. Acceptance of these terms
By accessing or using the Platform — including browsing listings, sending enquiries, claiming a listing or paying for any service — you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
You must be at least 18 years old and legally capable of entering into a binding contract under the laws of Australia to use the Platform.
3. Definitions
- Agent — a licensed Australian buyer’s agent or agency with a listing on the Platform.
- Buyer — a person using the Platform to discover, compare or enquire with Agents.
- Listing — a profile published on the Platform representing an Agent.
- Featured Listing — a paid placement upgrade purchased by an Agent.
- Content — text, images, reviews, ratings, FAQs or other material published on the Platform.
- Imported Data — Content sourced from public databases (e.g. Google Business profiles, ABS, Domain, realestate.com.au) and republished on the Platform with attribution.
4. What TopBuyers provides
The Platform is a directory service that helps Buyers discover and compare Australian buyer’s agents. We provide:
- Searchable profiles of Australian Agents, with structured-data and AI-visibility infrastructure.
- Investment-report content for Australian suburbs, sourced from publicly available data.
- A free enquiry mechanism for Buyers to contact selected Agents directly.
- An optional paid Featured Listing upgrade for Agents.
5. What TopBuyers does NOT provide
This is critical and you should read it carefully. TopBuyers is not:
- A licensed real estate agent, buyer’s agent, financial adviser, mortgage broker or solicitor.
- A party to any contract, engagement or transaction between a Buyer and an Agent.
- The provider of property buying, advisory, valuation, negotiation or auction-bidding services.
- A guarantor of any Agent’s qualifications, licensing, performance, conduct, fees, or the outcome of any property transaction.
- The source of personalised financial, legal, tax or investment advice. Suburb reports and on-site content are general information only and do not take your personal circumstances into account.
You must conduct your own due diligence on any Agent before engaging them, including verifying their current licensing with the relevant state regulator and reviewing the engagement contract they propose.
6. Buyer accounts and enquiries
Buyers may submit enquiries to one or more Agents through the Platform without creating an account. When you submit an enquiry, the Agent you selected (and, for record-keeping, TopBuyers) receive your name, contact details and message.
We do not pool buyer details, sell them to third parties, or share them with Agents you did not select. See our Privacy Policy for full details.
7. Agent accounts, listings and Featured upgrades
Eligibility. To claim or maintain an Agent account, you must hold a current real estate licence in the Australian state(s) you operate in and represent a registered Australian business.
Accuracy. You are solely responsible for the accuracy, currency and legality of any Content you publish on your Listing, including fees, qualifications, areas served and credentials. Misleading or deceptive conduct is not permitted and may result in immediate suspension.
Featured Listings. Featured Listing fees are payable in advance for the period selected and are non-refundable except as required by the Australian Consumer Law (see clause 15). Featured placement does not constitute an endorsement of the Agent by TopBuyers.
No agency relationship. Nothing in these Terms creates a partnership, joint venture, employment or agency relationship between you and TopBuyers.
8. Imported public data and listing claims
The Platform may include unclaimed Listings created from Imported Data. We import this data in good faith from publicly available sources with attribution preserved. If you are the Agent or business represented by an unclaimed Listing, you may:
- Claim the Listing via the on-page “Claim this listing” link. Upon verification of your identity (typically via business-email confirmation), you receive editing access.
- Request removal at any time by emailing hello@topbuyers.com.au. We process removal requests within five (5) business days.
- Request correction of any factual error in your Listing through the same email.
9. Reviews, ratings and content moderation
Reviews and ratings on Listings may be imported from public sources such as Google, with the original author’s attribution preserved. We do not invent, alter, edit, reorder or remove reviews to favour any party.
If you believe a review on the Platform is false, defamatory, misleading or breaches these Terms, report it via the “Report this listing” link on the relevant Listing or email hello@topbuyers.com.au. We review every report within one (1) business day and act in accordance with our content policy and applicable law.
10. Acceptable use
You must not:
- Use the Platform in any way that violates Australian law, including the Australian Consumer Law, the Privacy Act 1988 (Cth), or any state real estate licensing legislation.
- Publish or submit Content that is false, defamatory, infringing, harassing, discriminatory, obscene or otherwise unlawful.
- Submit a review you have a conflict of interest in, or impersonate another person.
- Scrape, harvest, mirror, reverse-engineer or access the Platform other than through the user interface provided.
- Attempt to interfere with the security, availability or integrity of the Platform.
- Use Buyer enquiries received via the Platform for any purpose other than responding to that specific Buyer about the matter they raised.
- Resell, sublicense or redistribute Content or Listings without our written permission.
11. Intellectual property
The Platform, its design, software, branding, schema architecture and original Content are owned by TopBuyers and protected by Australian and international intellectual-property law. You may not copy, modify, distribute or create derivative works of any part of the Platform without our prior written consent, except as expressly permitted by these Terms or by law.
When you submit Content (including by claiming a Listing and publishing your profile), you grant TopBuyers a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, display and distribute that Content for the purpose of operating, promoting and developing the Platform.
12. Privacy and data
Our handling of personal information is governed by our Privacy Policy, which forms part of these Terms by reference. We do not sell Buyer personal information to third parties under any circumstances.
13. Third-party links and integrations
The Platform may contain links to or integrations with third-party websites, applications and services (such as Google Maps, Calendly, payment processors, or social networks). We do not control those third parties, and your use of them is governed by their own terms. TopBuyers is not responsible for the availability, content, privacy practices, or actions of any third party.
14. Disclaimers
Subject to clause 15 (Australian Consumer Law), the Platform and all Content are provided “as is” and “as available” without warranty of any kind. We do not warrant that:
- The Platform will be uninterrupted, error-free, secure or free from viruses or other harmful components.
- Any Listing accurately reflects the current qualifications, licensing, fees, areas served or performance of an Agent.
- Reviews, suburb data, median prices, yields, growth figures or infrastructure information are current, complete or accurate. They are general information only.
- Any Agent will be available, willing or qualified to assist with your specific property purchase.
- Any property purchase, negotiation or auction outcome will achieve any particular result.
15. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any equivalent legislation. Where the Australian Consumer Law applies and a guarantee, right or remedy cannot be excluded, our liability for failing to comply is limited (at our option) to:
- The supply of the services again; or
- The payment of the cost of having the services supplied again.
16. Limitation of liability
Subject to clause 15, to the maximum extent permitted by law:
- TopBuyers will not be liable for any indirect, incidental, consequential, special or punitive loss or damage, including loss of profit, loss of opportunity, loss of data, or loss of business, arising out of or in connection with your use of the Platform or any Agent engagement initiated through it.
- Our total aggregate liability to any party for all claims arising out of or in connection with the Platform in any 12-month period will not exceed AUD $200, or the total amount that party paid to TopBuyers in that period (whichever is greater).
- We are not liable for any act, omission, advice, conduct or performance of any Agent. Any dispute regarding an Agent’s services is solely between the Buyer and the Agent.
17. Indemnity
You agree to indemnify and hold TopBuyers harmless against any claim, loss, liability, cost or expense (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms; (b) Content you publish or submit; (c) your engagement with any Agent or Buyer through the Platform; or (d) your violation of any law or third-party right.
18. Suspension and termination
We may suspend or terminate your access to the Platform at any time, with or without notice, if we reasonably believe you have breached these Terms, acted unlawfully, or where required by law. Featured Listing fees paid in advance are non-refundable in the case of termination for breach.
You may stop using the Platform at any time. Agents may request closure of their account by emailing hello@topbuyers.com.au. Listings imported from public data may remain on the Platform after account closure unless removal is specifically requested.
19. Changes to these terms
We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the current version. For material changes (those that meaningfully affect your rights or obligations), we will give reasonable notice — by email to Agents with accounts, by an on-site banner, or both — before the change takes effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
20. Governing law and dispute resolution
These Terms are governed by the laws of New South Wales, Australia. You and TopBuyers submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts competent to hear appeals from them.
Try to resolve disputes first. Before commencing any formal proceedings, you agree to first contact us at hello@topbuyers.com.au with a written description of the dispute, and to work in good faith to resolve it for at least 30 days.
